NookSky Weather, operated by Diorama Labs LLC ("we", "us"), shows weather forecasts and generates stylized AI artwork ("dioramas") and short animations from photos you upload. By using the app you agree to these terms.
You must be at least 13. If you are under 18, use the app only with a parent or guardian who agrees to these terms.
You must own or have the right to use any photo you upload, including permission from anyone who appears in it, and you must not upload other people's private property without permission or any unlawful content. You keep ownership of your photos and of the dioramas generated for you. Because AI can produce similar results for similar inputs, we cannot guarantee your generated content is unique.
Your dioramas and animations are for your personal, non-commercial use, including sharing them on your own social media. You may not, and may not let anyone else: (a) sell, license, or otherwise commercialize them; (b) use them in any product, service, or advertising, or distribute them at scale; (c) use them — or access, copy, or scrape the app or its content — to develop or train any artificial-intelligence model or any product that competes with the app; (d) remove or alter any watermark; or (e) access the app by automated means. We reserve all rights not expressly granted.
You grant Diorama Labs LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, adapt, and create derivative works from your uploaded photos and the content generated from them, in order to operate, secure, and improve the app and our products and services. You also grant us the right to display, reproduce, and distribute the dioramas and animations generated for you to promote the app; we will not publish your original photo. This license survives deletion only for content already used in published material and for de-identified or aggregated data. We do not sell your personal data or create biometric identifiers from your content. By choosing to create or animate, you consent to your content being processed by the AI providers described in our Privacy Policy.
Photos are processed by Google's Gemini AI and animations by the Kling AI API, and are subject to those providers' content policies. You must not upload content that is sexually explicit; that depicts, sexualizes, or endangers minors; that is violent, hateful, or harassing; that impersonates a real person; that is otherwise illegal; or that you do not have the rights to use. We may reject uploads and suspend installations that repeatedly violate these rules; when a photo is rejected, its credit is returned. You also agree not to abuse the service — bypassing purchase requirements, tampering with credits, scripting generation requests, or interfering with our systems.
Dioramas and animations are produced by third-party AI models. Results are stylized, vary between runs, and are not guaranteed to match any expectation of likeness or quality. Output is unpredictable and may be inaccurate, distorted, or — despite content filters — surprising or objectionable, and may depict people, animals, or property in ways you did not intend. The app is for personal entertainment, and all output is provided "as is"; you view, save, and share it at your own discretion and risk. To the maximum extent permitted by law, we are not responsible or liable for AI-generated output. If output troubles you, email [email protected] and we may remove it.
Apple bills purchases under its terms and handles all refunds. Credits have no cash value, are tied to your installation, and are non-transferable. We may return credits for a failed generation. Deleting your account forfeits unused credits without refund; your one-time App Store unlock stays with your Apple ID and can be restored with "Restore Purchases".
You represent that you hold all rights and permissions for every photo you upload — including copyright and the privacy, publicity, and likeness rights of anyone identifiable — and that your uploads and the content you generate and share are lawful. You agree to indemnify and hold harmless Diorama Labs LLC and its officers, members, and contractors from any third-party claim, loss, or expense (including reasonable legal fees) arising out of your photos, the instructions you give, the content generated from them, and how you use or share it. This does not apply to claims caused by our own unlawful acts, and nothing here waives a right you have under consumer-protection law that cannot be waived.
We respond to notices of alleged copyright infringement and, in appropriate cases, terminate repeat infringers. Send notices to our designated agent:

A valid notice must include your signature; identification of the copyrighted work and of the infringing material and where it is located; your contact information; and statements of your good-faith belief that the use is unauthorized and, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.
Weather data is provided by Apple Weather and other sources, and air-quality data is derived from preliminary US EPA AirNow reports and may be revised. All of it is provided "as is" — do not rely on the app for safety-critical decisions; always follow official guidance.
The app is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. To that same extent, our total liability for any claim is limited to the amount you paid in the app in the twelve months before the claim.
These terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms are the entire agreement between you and Diorama Labs LLC about the app. We may update them; material changes will be posted here with a new effective date, and continued use after a change means acceptance.
